If payment has already been processed for a cancelled order, we will provide an appropriate refund.

5. Pricing

All prices displayed on our website are in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) where applicable.

We reserve the right to change prices at any time without notice.

Prices displayed at the time an order is accepted will apply to that order.

For security and legal compliance purposes, we may require proof of identity before processing or delivering certain orders. Acceptable identification may include:

  • New Zealand Driver Licence,
  • Passport.
  • Hospitality New Zealand 18+ Card or Kiwi Access Card.

7. Delivery and Delivery Charges

We currently deliver only to addresses within New Zealand.

Ownership and risk in products pass to the recipient upon successful delivery by the courier company.

If products are lost or damaged during transit, you must notify us within seven (7) business days by emailing manager@hernebaycellars.co.nz.

Upon confirmation from the courier company that delivery was unsuccessful or the goods were damaged in transit, we will offer either:

  • A replacement product; or
  • A full refund.

Delivery charges, where applicable, will be displayed during checkout.


8. Purchase Terms

By purchasing products from our website, you acknowledge and agree that:

Alcohol Purchases

Where your order includes alcohol:

a) You are legally entitled to purchase alcohol under New Zealand law;

b) You can provide valid proof of age and identity upon request before or at delivery, including a New Zealand Driver Licence, Passport or Hospitality New Zealand 18+ Card or Kiwi Access Card.

c) Alcohol must not be purchased on behalf of a person who is under the legal purchase age.

General Terms

You further acknowledge that:

e) We may refuse any order at our sole discretion;

f) We may disclose information to your bank, card issuer, payment provider, or debt recovery agency where reasonably necessary;

g) We may impose account limits, purchase restrictions or credit limits at our discretion.

17. Discount Codes

Promotional discount codes:

  • Cannot be combined with other promotions, discounts or offers unless expressly stated;
  • Cannot be applied to products already discounted unless expressly stated;
  • Must be used in accordance with any promotional conditions accompanying the code.

Where a discount code is applied contrary to these Terms, we reserve the right to cancel the affected order or adjust pricing before processing.

Discount codes have no cash value and are non-transferable unless otherwise specified.

18. Age Verification and Responsible Sale of Alcohol

Herne Bay Cellars is committed to complying with the Sale and Supply of Alcohol Act 2012 and promoting the responsible sale and consumption of alcohol.

By placing an order for alcohol through our website, you confirm that:

  • You are at least 18 years of age;
  • You are legally entitled to purchase alcohol in New Zealand;
  • The information you provide is accurate and complete; and
  • The alcohol is not being purchased on behalf of a person under the legal purchase age.

We reserve the right to verify the age and identity of any customer before accepting, processing or delivering an order. Acceptable forms of identification include:

  • New Zealand Driver Licence;
  • Passport; or
  • Hospitality New Zealand 18+ Card or Kiwi Access Card.

Alcohol deliveries may only be accepted by the purchaser or another person who is at least 18 years of age and who can provide valid identification upon request.

Our courier drivers and delivery agents are authorised to request identification and may refuse delivery where:

  • Acceptable identification cannot be produced;
  • The recipient appears to be under 25 years of age and cannot verify their age;
  • The recipient appears intoxicated; or
  • Delivery would otherwise breach applicable alcohol laws or licence conditions.

Where delivery is refused for any of the reasons above, the order may be cancelled and additional delivery charges may apply. Refunds for undelivered alcohol orders will be assessed at our discretion and in accordance with applicable law.

We reserve the right to refuse any order that we reasonably believe may breach the Sale and Supply of Alcohol Act 2012 or any other applicable law.

Thank you
